Welcome to AMA, the platform for healthcare and wellbeing professionals that enables you to offer your services to members of the public, who are looking to improve their health and wellbeing, and for them to be able to book your services via AMA.
You can also contact other healthcare and wellbeing professionals to create collaborative packages for such members of the public.
Please note that this Privacy Policy does not cover any personal data you collect directly from members of the public who contact you via our platform to book your services.
For more details of how we will process this personal data on your behalf please see the relevant section in our Terms.
You are responsible with complying with all data protection laws when you collect, process and use customers personal data for your own purposes (and you hereby acknowledge and agree that we have no responsibility or liability to you in this regard).
This Privacy Policy explains all about the personal data we collect from you for the purposes of providing you with our services and keeping your up to date with our latest services and offers, including sending you emails and other electronic messages.
You may choose to include more details into your profile and listing than we need to collect and process for our own purposes and any such personal data you upload is of your own volition.
This Privacy Policy sets out how we will collect, use, process and protect your personal data.

The type of personal information we collect
We currently collect and process the following information:
• Your first name, last name and contact details including your email address and telephone number and postcode;
• Your biography, including details of your profession, qualifications, job title, business name, skills, experience, specialisms and work history;
• Membership of professional bodies (including your membership number, duration and renewal date);
• Photos and/or videos including your image and likeness;
• Your availability (via a link to your calendar);
• Your city/location (which you can select manually);
• The fees for your services;
• Your bank/credit card details;
• IP address;
• Social media; and
• video recording for verification purposes.
We do not intend to collect any Special Category Data relating to e.g. personal data revealing your racial or ethnic origin; political opinions; religious or philosophical beliefs; trade union membership; genetic data; biometric data (where used for identification purposes); data concerning health; sex life; and/or sexual orientation so please do not share any of these types of data with us.
Should you collect this data yourselves from members of the public you are responsible for ensuring you are compliant with applicable data protection laws (and you will indemnify and hold us harmless against any breach of such laws).
How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
• From you as part of the pre-registration approval
• You input your details as part of creating your account, profile and listings;
• You share your data on our platform, including via direct messages with members of the public looking to use your services;
• We automatically collect your IP address as part of you using our website;
• being part of our mailing list;
• When you opt-in to receive emails and messages from us;
• We use cookies on our website that, for example, monitor your use of the platform and that enable us to provide you with a chat function] and we use third party platforms, such as Usercentric’s Cookiebot, that may use cookies to collect data;
• When members of the public provide testimonials via our platform regarding their experience of your services.

How we use the personal information that you provide to us
We use the information that you have given us in order to:
• do our pre-registration checks;
• for you to complete your profile and promote your services to members of the public;
• facilitate you meeting and communicating members of the public;
• facilitating members of the public being able to directly book your services via our platform;
• informing you of collaboration opportunities;
• using it to promote our platform and services;
• analyse the impact of our services; and
• Blog and educational videos.
We also use the information to send you regular email newsletters to keep you up to date with our work and to inform you of future events.
We may use your name and photo on our website to promote your services.

Use of your own and members of the public’s personal data
When communicating with members of the public via our platform please do not upload any personal data that you would not want others to know about you (or encourage them to do so).
Please do not share any personal data you receive about other professionals or members of the public via our platform with anyone else. If you receive this data yourself via your direct contact with another professional or members of the public you must process and protect it in accordance with your own privacy policy and data protection obligations.
Should you have sessions with members of the public and take photos or videos of the sessions please do not share their name, photo, likeness or other personal data without their permission.

Ways in which we share your personal data
We may share your personal data with:
• members of the public;
• other professionals, including via a chat function (provided by a system such as Sendbird);
• IT services providers (such as AWS, Flipside, Hubspot, Sendbird, Twillo, Usercentrics and Google/Microsoft and calendar interface providers);
• Payment card processors and banks (such as Stripe);
• user authentication partners (such as Amazon Cognito);
• Employees and freelancers we use;
• Professional advisers (such as our accountants and lawyers);
• HMRC and other governmental bodies;
• Potential investors in our business.

The lawful bases we use to collect and process your personal data
The lawful bases we rely on for processing this information are:
Consent: we will ask for your consent to opt-in to receiving emails and marketing messages
Contractual obligation: if you apply to become a member, are a member or participate in our online community (including collaborating with other professionals) we will need to process your personal data in order to provide you with the relevant services
Legitimate Interest: in order to carry out business development activities, including marketing and to assess the effectiveness of engagement and to communicate with and grow the platform we will analyse your personal data, including tracking how you interact within the platform (and we have carried out a Legitimate Interests Assessment to ensure we have balanced our need to do grow and develop the community with your right to privacy).
Legal Obligation: we may need to provide your personal data to a public body such as HMRC in order to comply with our legal obligations regarding paying tax.

How we store your personal information
Your information is securely stored within own database, which is hosted in a data centre located in the UK (via Amazon RDS).

How we look after your personal information
We also employ industry standard security measures in relation to our platform and if you would like more details please see our Information Security document.
We also ensure that our employees, freelancers and service providers fully understand their obligations to keep your personal data secure and confidential and that they have signed contracts with suitable confidentiality and data processing provisions.

How long we keep your personal data for:
Financial and contractual data: we keep your personal data in relation to financial and contractual matters for a period of 6 years from its completion to comply with our potential legal and reporting requirements.
Business development and marketing: we keep your personal data for business development and marketing purposes for the duration of your membership and up to 6 months afterwards, after which time we will delete or destroy it.
User Administration: we keep your personal data for the purposes of administrating your membership for the duration of your use of the platform and up to 6 months afterwards, after which time we will automatically delete or destroy it.
If your application to be registered on and provide your services via AMA is unsuccessful, we will keep your details on record for 6 months after we notify you of your rejection, should you wish to apply again within that timeframe or to comply with our ‘Know Your Client’ obligations.

Your data protection rights
Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
